MOM introduces Fair Consideration Framework for fair employment of Singaporeans

 On 23 September 2013, the Ministry of Manpower (MOM) announced new rules, known as the Fair Consideration Framework, which require employers to consider Singaporeans fairly before hiring Employment Pass (EP) holders.

From 1 January 2014

Qualifying monthly salary for new EP applications will increase by S$300 from the current S$3,000 to S$3,300, taking into consideration individual qualifications and experience.

From 1 August 2014

Firms making new EP applications must advertise the job vacancy on a new jobs bank administered by the Singapore Workforce Development Agency (WDA). The advertisement must:

1.       Be open to Singaporeans;
2.       Comply with the Tripartite Guidelines on Fair Employment Practices, and;
3.       Run for at least 14 calendar days before submission of EP application.

Exceptions: Small firms with 25 or fewer employees, and jobs which pay a fixed monthly salary of $12,000 and above, will be exempted from the advertising requirement for practical reasons.

Firms who are flagged for nationality-based or other discriminatory HR practices can expect greater scrutiny, a longer review period for their EP applications, and restrictions imposed on their work pass privileges.
